Terms of use of the Pivo mobile student ID card

1. The Mobile Student ID Card service is provided by

2. Definitions

Student Organisation
Students’ union or other body representing students, which has signed an agreement with the Service Provider on the provision of a digital student ID card for its students.

Partner
A third party that accepts the Mobile Student ID Card as proof of student status and offers services and/or related benefits.

Pivo service
An application downloaded to a mobile device with which you can use services offered by the Service Provider or its Partners, and payment and financial management services.

3. Mobile Student ID Card service

The Mobile Student ID Card is a digital student ID card that can be downloaded to the Pivo application.

You can use the Mobile Student ID Card to verify your student status with the Service Provider and use services and/or benefits offered by the Service Provider on this basis. The Mobile Student ID Card service may also include advertisements by the Service Provider or its partners, or information concerning the available benefits.

4. Mobile Student ID Card’s availability and technical requirements

Enabling and using the Student ID Card requires that your Student Organisation has signed a service agreement with the Service Provider and that the Service Provider receives information on your valid membership and attendance from your Student Organisation or educational establishment.

Using the Mobile Student ID Card service requires a mobile device and a subscription for transferring data to the device. You are responsible for the operation and data security of your mobile device and for its compatibility with the Mobile Student ID Card.

Before you can use the Mobile Student ID Card, you must enable the Pivo application.

We release updates for the application: failure to implement such updates may prevent you from using the Mobile Student ID Card.

The Service Provider does not guarantee the uninterrupted availability of the Mobile Student ID Card. The Service Provider may interrupt provision of the Pivo service during maintenance, for example.

5. Customer’s responsibility and careful use

As a customer, you will be responsible for ensuring that any information you give is correct and kept up to date.

Your Mobile Student ID Card is personal. Store the Pivo Service identifiers, which enable use of the Student ID Card, safely in order to prevent other persons from misusing the card.

6. Service charges and fees

Using the Mobile Student ID Card is free of charge but requires online data transfer.

Your operator may charge for data transfer related to mobile data, and you will be responsible for any expenses caused by use of the Mobile Student ID Card. The Service Provider will not be responsible for charges related to data transfer or other telecommunication services. You must reach separate agreement with each Partner on any fees or charges for services and/or benefits offered by them.

7. The Service Provider’s right to disable the Mobile Student ID Card

The Service Provider has the right to disable the Mobile Student ID Card and prevent its use entirely or in part if:

  • you have provided false information during registration or later;
  • you are subject to international or national sanctions;
  • safe use of the Mobile Student ID Card has been compromised;
  • there is reason to suspect that the Mobile Student ID Card is being used in an unauthorised manner or with fraudulent intent;
  • the Service Provider does not receive information from the Student Organisation or educational facility on your membership or attendance;
  • the agreement between the Service Provider and educational facility on the provision of the digital student ID card has been terminated; or
  • the Service Provider needs to change the Mobile Student ID Card or its terms and conditions and your approval is required for continued use with new terms and conditions or features.

The Service Provider will inform you of the closure of the Mobile Student ID Card via the Pivo application.

International sanctions refer to a sanction, financial sanction, export or import ban, trade embargo or other restrictive action imposed, administered, approved or executed by the Finnish government, United Nations, European Union, United States of America and United Kingdom or their competent authorities or governing bodies.

8. Liability for loss or damage

The Mobile Student ID Card is provided ‘as is’, and we do not guarantee that it is error-free or available without interruption. If we cause loss or damage by acting in breach of the agreement, we will only compensate direct loss or damage, unless we caused the damage wilfully or through gross negligence, or unless otherwise provided by mandatory legislation.

The Service Provider will not be responsible for the services or benefits of Partners, or for the terms and conditions, payments, performance or data security related to such services or benefits.

The Service Provider will not be held liable for any damage or loss caused by a force majeure event or any unreasonable, comparable impairment of the Service Provider’s operations due to a similar cause. Force majeure encountered by the Service Provider or its supplier entitles the Service Provider to suspend provision of the Mobile Student ID Card.

9. Changes to the agreement, its terms and conditions, and service features

The Service Provider has the right to change these terms and conditions, the content of the Mobile Student ID Card service and the requirements set for devices intended for use of the Mobile Student ID Card service by sending notice of this to your mobile device. Changes that do not increase your responsibilities or affect your rights will take effect immediately. If a change will increase your responsibilities or affect your rights, it will take effect no earlier than one month after you received information about it.

The agreement will continue with the altered content unless you cancel your Mobile Student ID Card before the change takes effect. You have the right, until the effective date of the changes, to cancel the agreement with immediate effect as described in section 14.

If necessary, instead of proceeding as described above, we may require you to accept the new terms and conditions before you continue using the Mobile Student ID Card.

10. Personal data processing

The Service Provider will process your personal data in accordance with the legislation in force and in a manner described in greater detail in the Privacy Notice of Pivo Wallet. We recommend that you read the privacy protection information referred to.

The Privacy Notice is available at www.pivo.fi

We may store information related to your use of the service and transactions and record telephone calls made to customer service. The stored information and recordings may be used for purposes specified in the Privacy Notice.

11. Intellectual property rights

All rights related to the Mobile Student ID Card service and its content, including proprietary rights, copyright, patents, trademarks and all other intellectual property rights, belong to the Service Provider and/or a third party, unless otherwise specifically agreed on in some respects.

You have the right to use the Mobile Student ID Card only in the manner described in these terms and conditions. When using the Mobile Student ID Card, you may not infringe the intellectual property rights of the Service Provider. Neither the Mobile Student ID Card nor its content (in part, as such, or modified) may be modified or copied in any manner whatsoever or shared, distributed, transmitted, displayed publicly or published in another manner.

12. Transfer of the agreement

The Service Provider has the right to assign this agreement, including the related rights and obligations, in full or in part to the party specified by the Service Provider. You have no right to assign this agreement to a third party.

13. Cancelling the Pivo service agreement

You have the right to cancel the implementation and contract of the Mobile Student ID Card within 14 days of concluding the agreement by informing Pivo of this in an email message sent to asiakaspalvelu@pivolompakko.fi or by phoning Pivo’s customer service during the service hours stated on the pivo.fi website.

14. Validity and cancellation of the agreement

The agreement is effective until further notice.

You can terminate the agreement by uninstalling the Pivo application or by removing the Mobile Student ID card service from Pivo. The Service Provider may cancel this agreement with a one (1) month notice period from the date of cancellation.

This agreement will also terminate if the Service Provider does not receive information on your membership or attendance from the Student Organisation or educational facility for 12 months.

The Service Provider has the right to cancel the agreement with immediate effect if you are in material breach of these terms and conditions or use the Mobile Student ID Card in activities contrary to the law or good practice.

15. Applicable laws, non-judicial procedures and jurisdiction

The laws of Finland apply to this agreement, with the exception of choice of law rules, regardless of the country where the service is used.

If you disagree with the decision made by the Service Provider, you can submit the matter in writing to OP Financial Group’s Customer Ombudsman (www.op.fi/asiakasasiamies). The Customer Ombudsman is a fast and free-of-charge complaint-handling body, which handles complaints independently of any previous decision.

You can submit the matter to the Consumer Disputes Board – www.kuluttajariita.fi. You can also bring an action in the District Court of your Finnish domicile, or in Helsinki. If you are not domiciled in Finland, the place of jurisdiction is the Helsinki District Court.
